Terms of Service & Intellectual Property Protection Agreement

The Beat Goes On: Celebrating 50 Years of Hip-Hop

Effective Date: March 4, 2026

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User”, “Customer”, or “Licensee”) and Cando Media Group LLC and/or Rob Cando (“Company”, “we”, “our”, or “us”) governing the purchase, access, use, licensing, and distribution of The Beat Goes On: Celebrating 50 Years of Hip-Hop puzzle book and any associated materials, formats, derivatives, or services (collectively referred to as the “Product”).

By purchasing, accessing, or using the Product, you acknowledge that you have read, understood, and agree to be bound by these Terms.

If you do not agree, you must not purchase, access, or use the Product.


1. Intellectual Property Ownership

All intellectual property contained within the Product is the exclusive property of Cando Media Group and/or Rob Cando.

This includes but is not limited to:

• Puzzle concepts and frameworks
• Crossword puzzle structures
• Word search designs
• Puzzle mechanics and layouts
• Educational frameworks integrating hip-hop history with puzzles
• Written content, clues, and solutions
• Graphic design and layout
• Branding and trademarks
• Product titles and taglines
• Artwork and illustrations
• Cultural narrative frameworks
• Marketing and promotional materials

All rights not expressly granted are reserved by Cando Media Group.


2. Limited License Grant

Upon purchase, the Company grants the User a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Product solely for:

• Personal entertainment
• Personal educational use
• Non-commercial household use

This license does not transfer ownership of any intellectual property rights.

The license may be revoked immediately if these Terms are violated.


3. Prohibition of Reproduction and Distribution

Except as expressly permitted under these Terms, the User may not:

• Reproduce the Product in any format
• Photocopy or scan pages for distribution
• Upload the Product to websites, forums, or digital repositories
• Share digital versions via email or cloud storage
• Post puzzle solutions online in full or substantial part
• Distribute classroom copies without licensing
• Publish puzzle content in blogs, newsletters, or media outlets

Unauthorized reproduction or distribution constitutes copyright infringement.


4. Derivative Works Restriction

The User may not create derivative works based on the Product or its underlying concepts without written permission.

Prohibited derivative uses include:

• Creating similar hip-hop themed puzzle books
• Replicating puzzle structures or clue systems
• Adapting puzzles for mobile apps or games
• Repackaging puzzles into courses or paid educational materials
• Publishing similar puzzle collections based on the same concept framework

This clause protects the core concept of hip-hop puzzle education.


5. Commercial Use Prohibited Without License

The Product may not be used for commercial purposes without written licensing authorization from Cando Media Group.

Prohibited commercial uses include:

• Selling puzzles individually
• Incorporating puzzles into mobile apps or software
• Publishing puzzles in magazines or newspapers
• Using puzzles for paid events or competitions
• Creating merchandise derived from puzzle content
• Using puzzles in subscription products or paid communities

Organizations wishing to use the Product commercially must obtain a commercial licensing agreement.


6. Institutional & Educational Licensing

Schools, universities, educational institutions, libraries, and nonprofit organizations may use the Product for instructional purposes only if:

• The original purchased copy is used
• Content is not reproduced or redistributed
• The material is not uploaded to learning platforms without licensing

Bulk classroom use or curriculum integration requires educational licensing authorization.


7. Digital Product Protection

If the Product is delivered digitally (including PDF, e-book, or interactive formats), the User agrees not to:

• Upload files to public or private file-sharing services
• Share files via cloud storage platforms
• Post the product on social media or forums
• Convert the product into another digital format for redistribution

Each digital purchase grants a single-user license only.


8. Artificial Intelligence & Data Training Restrictions

The Product may not be used for:

• Training artificial intelligence models
• Dataset generation
• Machine learning content scraping
• Automated puzzle generation systems
• Text mining or algorithmic analysis

The User may not input, upload, or feed the Product or its contents into AI systems, LLMs, or training datasets without written authorization.

This includes both commercial and non-commercial AI tools.


9. Anti-Scraping & Automated Access

Users may not use automated tools to:

• Extract puzzle data
• Scrape content
• Copy clues or answers
• Generate puzzle databases

Such actions constitute unauthorized access and intellectual property theft.


10. Anti-Piracy Enforcement

Cando Media Group actively enforces its intellectual property rights.

If unauthorized distribution is detected, the Company may:

• Issue DMCA takedown notices
• Revoke licenses
• Block access to future products
• Seek statutory damages
• Pursue civil litigation
• Recover attorney fees and enforcement costs

Maximum statutory damages for copyright infringement may reach $150,000 per violation under U.S. law.


11. Cultural & Informational Disclaimer

The Product references artists, songs, and historical moments in hip-hop culture for educational and commentary purposes.

All such references fall under fair use commentary, cultural documentation, and educational context.

The Company does not claim endorsement from any referenced artist, brand, or record label unless explicitly stated.


12. Refund Policy

Due to the intellectual property nature of the Product:

Digital products are non-refundable.

Physical products may be returned within 14 days of delivery if unused and in original condition.

Return shipping costs are the responsibility of the customer unless the product arrives damaged.


13. Limitation of Liability

To the maximum extent permitted by law, Cando Media Group and Rob Cando shall not be liable for:

• Indirect damages
• Incidental damages
• Consequential damages
• Loss of revenue or profits
• Loss of data
• Educational outcomes from product use

The Product is provided “as-is” without warranty of any kind.


14. Modification of Terms

Cando Media Group reserves the right to update or modify these Terms at any time.

Continued use of the Product after modifications constitutes acceptance of the revised Terms.


15. Governing Law

These Terms shall be governed by the laws of the State of Wyoming.

All disputes shall be resolved exclusively in the courts located in Cheyenne, Wyoming.

Concept Protection Clause

The unique integration of hip-hop cultural history with puzzle-based educational entertainment developed by Rob Cando is proprietary creative intellectual property. Replicating or publishing substantially similar puzzle products derived from this framework may constitute infringement and unfair competition.
